eSIMTours Affiliate Program Terms and Conditions

These Affiliate Program Terms and Conditions ("Agreement") govern your participation in the eSIMTours Affiliate Program ("Program") operated by NEW STAR COMMUNICATION PTE. LTD. ("eSIMTours," "we," "us," or "our").

By applying to or participating in our Program, you ("Affiliate," "you," or "your") agree to be bound by this Agreement. If you do not agree with these terms, you may not participate in the Program.

1. Program Overview

eSIMTours is a global eSIM service provider offering digital SIM cards for travelers. Our Affiliate Program allows you to earn commissions by promoting eSIMTours products to your audience.

How It Works

Apply through our affiliate registration portal
Upon approval, access your affiliate dashboard
Use your unique affiliate links to promote eSIMTours
Earn commissions on qualifying purchases

2. Definitions

Affiliate Link: Your unique tracking URL provided in your dashboard
Commission: Payment you earn for qualified purchases
End User: A customer who purchases eSIMTours products
Net Revenue: Purchase price minus taxes, fees, refunds, and discounts
Qualified Purchase: A purchase that meets all criteria in Section 3
Tracking Period: 30 days from when a user clicks your link

3. Commission Structure

3.1 How to Earn Commissions

You earn commissions when:

A user clicks your unique affiliate link
That user makes a purchase within 30 days
The purchase is not refunded or charged back

3.2 Commission Rate

Standard Rate: 10% of Net Revenue
Special Promotions: May vary (you will be notified)

3.3 Payment Details

Payment Schedule: Monthly, by the 20th day of the second month following that month
Minimum Payout: USD $10 (balances roll over)
Payment Methods: PayPal, wire transfer, etc.
Tax Responsibility: You are responsible for reporting and paying taxes on your earnings

4. What Qualifies for Commission

A purchase qualifies for commission ONLY if:

Proper Tracking: Purchase is tracked through our system
Valid Payment: Completed with valid payment method
No Refunds: Not refunded or charged back
No Fraud: Not from fraudulent or abusive activity

5. What Does NOT Qualify

No commissions will be paid for:

Existing Customers: Users who already had eSIMTours accounts
Unauthorized Links: Using expired or manipulated links
Prohibited Promotions: Using unauthorized coupon codes
Fraudulent Activity: Any purchases we determine to be fraudulent

6. Your Responsibilities

Must Do

Disclose Relationship: Clearly state you're an affiliate and may earn commissions
Follow Laws: Comply with all applicable laws (advertising, privacy, anti-spam)
Use Approved Materials: Use only banners and links from your dashboard
Keep Info Updated: Maintain current contact and payment information

Must NOT Do

Brand Bidding: Do NOT bid on "eSIMTours" or similar terms in paid ads
False Claims: Do NOT make misleading statements about our products
Spam: Do NOT send unsolicited emails or messages
Illegal Content: Do NOT promote on sites with illegal/offensive content
Cookie Stuffing: Do NOT use deceptive tracking methods
Create Confusion: Do NOT imply endorsement or partnership beyond affiliate relationship

7. Intellectual Property

7.1 Our Property

eSIMTours owns all rights to our brand, logos, and content. You may use provided materials only for promoting our products.

7.2 Restrictions

Do NOT:

Modify our logos or branding
Register domains with "eSIMTours"
Use our brand to suggest partnership beyond affiliate relationship
Challenge our intellectual property rights

7.3 Your Content

You own your original content, but by sharing it with us, you allow us to use it for marketing (with attribution).

8. Termination

8.1 How You Can Leave

Email request to affiliates@eSIMTours.com
Close your account in the dashboard
Unsubscribe from communications

8.2 When We May Terminate

We may terminate immediately if you:

Violate this Agreement
Engage in fraudulent activity
Harm our brand reputation
Violate applicable laws

8.3 After Termination

You'll receive unpaid commissions for qualified purchases
You must remove all eSIMTours links and materials
Licenses to use our materials end immediately

9. Important Legal Terms

9.1 Relationship

You are an independent contractor, not our employee. You're responsible for your own taxes and expenses.

9.2 Liability Limits

We are not liable for:

Indirect or consequential damages
Lost profits or opportunities
Third-party platform issues
Maximum liability: Total commissions paid in last 12 months

9.3 Your Indemnification

You agree to protect us from claims arising from:

Your breach of this Agreement
Your violation of laws
Your promotional activities
Your use of our intellectual property

9.4 Changes to Terms

We may update these terms at any time. Continued participation means you accept the updated terms.

10. Dispute Resolution

10.1 Governing Law

Singapore law governs this Agreement.

10.2 Resolution Process

Negotiation: Try to resolve informally first
Mediation: If needed, use Singapore International Mediation Centre
Arbitration: Final resolution through Singapore International Arbitration Centre

10.3 Injunctive Relief

Either party may seek court orders to protect intellectual property or confidential information.

11. General Terms

11.1 Entire Agreement

This is the complete agreement between us.

11.2 Changes

We may change these terms by posting updates on our website.

11.3 Notices

We'll contact you at the email you provided.

11.4 Assignment

You cannot transfer your rights without our consent.

11.5 Severability

If any part is invalid, the rest remains valid.

11.6 No Waiver

Not enforcing a right doesn't mean we waive that right.

Q: How are refunds handled? A: Commission is reversed if a purchase is refunded.

Q: When will I get paid? A: Commissions for sales generated during any month will be disbursed to you by the 20th day of the second month following that month. For example, commissions earned from sales in March are paid out by May 20th.

Q: Is there a minimum payout? A: Yes, USD $10 minimum.

Q: Can I use my own creatives? A: Only with our prior written approval.

Acceptance

By clicking "I Agree" during registration or by continuing to use the eSIMTours Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
